Failure to Disclose Design Defects

The 3M Dual-Ended Combat Arms earplugs were manufactured initially by Aearo Technologies, and the company was aware of the flawed design as early as 2000 according to a 3M whistleblower lawsuit initialted by Moldex-Metric under the False Claims Act, which resulted in a 9.1 million settlement.

There is also a complaint in the 3M lawsuit that alleges that 3M and Aearo Technolgies manipulated the test results of the earplugs to meet the U.S. government’s required product standards. These fraudulent activities and false claims resulted in damages that 3M has to pay in the settlement.
